A proposal for two concrete mixing plants was approved by the Town of Cicero Planning Board months ago. But, along the way, Riccelli Enterprises wanted to modify their plans to include a bituminous plant, which uses some liquid asphalt for a mix that is often applied to driveways.
"My daughter goes to school less than a mile away from there," said Curtis Harrington. "We're concerned with the health and well-being of our children, of our local community, and our own personal property values."
Harrington sat beside several neighbors who complained that they didn't get much notice that the planning board was reviewing the request on Monday night.
Representatives from Riccelli Enterprises were invited to share the details of their proposal and answer questions from board members.
The definition of asphalt become a central part of the conversation.
Under current zoning rules for the site, the Town of Cicero does prohibit the "manufacture or processing" of several materials, including asphalt.
"That's going to become the tough part...defining what is asphalt. We're certainly not manufacturing, but are we processing it?" asked planning board chairman Robert Smith.
Riccelli's representative argued that liquid asphalt is a component of the mix they'd supply, but the end product would not be defined as asphalt.
"New York State DEC has to issue a clean air permit and it is monitored by them. Obviously there is always concern, as we will have, over any odors that are emitted from the belt type concrete batching plant," said chairman Smith.
The planning board's decision can and may face legal challenges from either side.
"There's a limit to how much cancer causing materials they can let into the air. Any amount is not acceptable to me. It's not in the code," said Terri Luckett, who lives near the proposed site. "We all bought our homes with the understanding that the zoning code was going to protect us from facilities like this and we rely on that."
Neighbors will get a chance to share their thoughts, on the record. A public hearing is scheduled for May 6 at 6:30 p.m. in the Cicero Town Hall.
